WSIA Events Consent & Waiver
General Wavier, Assumption of Risk and Release of Liability (“Waiver”)
As consideration for registering for and participating in this Wholesale & Specialty Insurance Association (“WSIA”) event (“Event”), Attendee agrees that:
Attendee is aware of the risks associated with traveling to/from and participating in this Event. Attendee assumes all risks, both known or unknown, and accepts sole responsibility for injury, death, illness, damage, loss, claim, liability, or expense of any kind that Attendee may experience in connection with attending the Event, unless such loss is caused by the sole, gross negligence of WSIA. Attendee expressly agrees, to the maximum extent permitted by law, to release from liability, promises not to sue, and to discharge and hold harmless WSIA, its employees, directors, officers, agents, affiliates and representatives (collectively, “WSIA”), for and from any and all causes of action and claims, including claims for negligence resulting in any injury, death, illness, damages, or loss, to Attendee arising out of or related to participation in the event.
COVID-19 Global Pandemic
Specifically relating to the global COVID-19 pandemic, Attendee acknowledges the highly contagious nature of COVID-19 and voluntarily assumes the risk of exposure or infection by attending the Event and voluntarily accepts the risk of becoming exposed to or infected by COVID-19 at the Event and understands this Waiver includes all claims relating to services provided by any third-party vendor, including those which may offer medical services and/or medications. By accepting the vendor’s services, Attendee accepts all risks. WSIA is not responsible for errors, omissions, acts, or failures to act of any party or entity at the Event and/or the condition of the Event location(s).
In addition to any WSIA registration and participation policies for this Event, attendee agrees to observe WSIA’s recommendations and requests for health protocols and procedures implemented by WSIA and/or the CDC/state/local officials and hotel partners, including not participating in the Event if attendee is exhibiting known COVID-19 symptoms or has experienced a recent exposure.
Photo/Video/Audio Release and Consent
Attendee understands that certain activities or portions of the Event may be photographed and/or audio/video recorded. In consideration for attendance at the Event, Attendee grants permission (both now and in the future) to WSIA, and its employees and agents, to take and use images, photographs, audio/visual recordings, and/or their likenesses (“the Images/Audio”). Attendee agrees that WSIA owns the Images /Audio, and all rights related to them. The Images/Audio may be used in any manner or media by WSIA and/or third parties without notifying or compensating Attendee. Attendee waives any right to inspect or approve the Images/Audio.
Consent to Share Contact Information
Registration and attendance at or participation in WSIA events constitutes permission by the Attendee for WSIA to share Attendee’s contact information upon request with other WSIA members participating in the event.
Acknowledgement of Understanding
Attendee has carefully read this Waiver and fully understands that it is a release of liability, written to be as broad and inclusive as legally permitted by the laws of the State where the event is located. By registering for and attending the Event, Attendee is freely agreeing to the terms herein. No other representations concerning the legal effect of this document have been made.
